Final Pay Control

Final Pay Control was introduced under the radar in 2015 but has the potential to leave retiring employees or non GP partners with a large tax liability on retirement. Although this has not been well publicised there are some instances of practices being hit with six figure bills and if you think you may be effected we would urge you to seek advice at an early stage. The BMA Guidance on Final Pay Control is a good starting point if you meet or may meet the following criteria:

  • Applies to Officer and Practice Staff members of the 1995 Section of the NHS Pension Scheme, including 1995/2015 transition members. This includes non-GP Partners.
  • Applies to pay rises above a certain level (Inflation plus 4.5%) in the 3 years prior to retirement.
  • Base year pay is based on pay from the year commencing on the date 4 years prior to retirement.

Have you been impacted by annualisation?
We believe the current arrangements relating to annualisation within the 2015 NHS Pension Scheme are discriminatory and are prepared to take legal action to address this. In order to help strengthen our argument against this unacceptable process we need more examples we can use as test cases. Krishan Aggarwal, deputy chair of the GP Sessional subcommittee, explains what annualisation is and what to do if you have been affected by it . If you have been impacted by annualisation, please fill the survey and email us with your responses at pensions@bma.org.uk .
